Questions

What is Pre-Settlement Funding?

Pre-settlement funding is legal funding available for lawsuits that are active and pending. The case is not yet been settled and has not yet reached a verdict.  Under these circumstances, pre-settlement legal funding is sought.

What is Post-Settlement Funding?

Post-settlement funding or settlement funding is a form of legal funding available where cases have already been settled but payment is not yet been made. These tend to be shorter-term fundings. These are an option for those who need cash immediately even though a settlement should be coming soon. Settlements can take months or years to be paid depending on the situation of the case. Additionally, there is always the risk of bankruptcy being filed by the defendant, which can further delay or even eliminate the requirement that they pay.
With post-settlement legal funding, you receive the funds now.  These funds are made available to you and you only repay the funding once the settlement is paid. If the settlement is not paid, you repay nothing.
